Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CyWarn application ("App") and website ("Service"), operated by KCraft Studio LTD, a private limited company registered in Cyprus under registration number HE 485092, with its registered office at Neofytou Nikolaidi & Theod. Kolokotroni, ONISIFOROU CENTER, 2nd floor, Agios Theodoros, 8011 Paphos, Cyprus ("Company", "we", "us", or "our").
1. Acceptance of Terms
By downloading, installing, accessing, or using the CyWarn application or website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Service. You must be at least 14 years of age to use this Service. If you are under 18, you represent that your legal guardian has reviewed and agreed to these Terms.
2. Description of Service
CyWarn is an emergency alert aggregation service that collects and displays warnings from various international and local sources including, but not limited to, USGS (United States Geological Survey), EMSC (Euro-Mediterranean Seismological Centre), Cyprus Meteorological Service, NASA FIRMS (Fire Information for Resource Management System), Open-Meteo, GDACS (Global Disaster Alert and Coordination System), Meteoalarm, and official government notices. The Service provides real-time notifications about earthquakes, severe weather conditions, wildfires, civil defense alerts, and other emergency situations in Cyprus and surrounding regions.
3. Important Disclaimer
THE SERVICE IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY. CyWarn is a supplementary alert aggregation service and is NOT a replacement for official emergency warning systems, civil defence communications, or the 112 emergency number. CyWarn aggregates data from third-party sources and does not independently verify the accuracy, completeness, or timeliness of any alert or information. YOU SHOULD NOT RELY SOLELY ON CYWARN FOR EMERGENCY INFORMATION. In case of emergency, always follow official guidance from local authorities, emergency services (112 in Cyprus), civil defence, and government agencies. We strongly recommend having multiple sources of emergency information. The delivery of push notifications depends on factors beyond our control, including but not limited to: Apple Push Notification Service (APNs) and Google Firebase Cloud Messaging (FCM) availability; your device's network connectivity; your device settings, including battery optimization, Do Not Disturb mode, and notification permissions; and mobile carrier network conditions. We cannot guarantee that any specific alert will be delivered to your device, delivered within a specific timeframe, or displayed in a specific manner. CyWarn is not an official emergency authority and does not undertake or assume any legal duty to monitor, detect, or warn of emergencies. The Service does not guarantee coverage of all emergency events, all geographic areas, or all hazard types. The absence of an alert on CyWarn does not indicate the absence of danger.
4. User Accounts and Family Safety
Certain features of the Service, including the Family Safety feature, require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to keep this information updated. The Family Safety feature allows you to create family groups, share locations with group members, and send 'I'm Safe' check-ins during emergencies. You are responsible for obtaining consent from all family members before adding them to your family group. Location sharing is dependent on device permissions, network connectivity, and third-party services. We do not guarantee real-time or continuous location tracking.
5. Premium Subscription
CyWarn offers premium subscription features ("Family Safety Premium") that provide enhanced functionality. Subscriptions are billed through the Apple App Store or Google Play Store, depending on your device. By purchasing a subscription, you agree to the pricing and payment terms presented at the time of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your App Store or Google Play account settings. Refunds are subject to the policies of Apple or Google, as applicable. Subscriptions are managed by Apple or Google, and we do not have access to or control over their billing systems.
6. User Responsibilities and Conduct
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not: (a) use the Service to transmit any unlawful, harmful, threatening, abusive, or otherwise objectionable content; (b) attempt to gain unauthorized access to any part of the Service; (c) interfere with or disrupt the Service or servers; (d) use automated systems or software to extract data from the Service; (e) impersonate any person or entity; (f) use the Service for any commercial purpose without our written consent.
7. Intellectual Property
The CyWarn name, logo, and all related trademarks, service marks, and trade names are the exclusive property of KCraft Studio LTD. The App's design, code, graphics, user interface, and all content created by us are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code.
8. Third-Party Services and Content
The Service integrates data from third-party sources and may contain links to third-party websites or services. We do not control, endorse, or assume responsibility for any third-party content or services. Your use of third-party services is governed by their respective terms and policies. Alert data from sources such as USGS, EMSC, Cyprus Meteorological Service, and others remains the property of their respective owners and is used in compliance with their data usage policies. We do not guarantee that third-party data sources will continue to provide data or remain accessible.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT GUARANTEE THE ACCURACY, TIMELINESS, OR COMPLETENESS OF ANY ALERTS OR INFORMATION PROVIDED THROUGH THE SERVICE. WE DO NOT WARRANT THAT PUSH NOTIFICATIONS WILL BE DELIVERED SUCCESSFULLY, DELIVERED WITHIN ANY SPECIFIC TIMEFRAME, OR RECEIVED BY ANY SPECIFIC DEVICE. ALERT DATA IS SOURCED FROM THIRD PARTIES INCLUDING USGS, EMSC, NASA FIRMS, METEOALARM, CYPRUS METEOROLOGICAL SERVICE, AND OTHERS; WE ARE NOT RESPONSIBLE FOR ERRORS, OMISSIONS, OR DELAYS IN THEIR DATA.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KCRAFT STUDIO LTD AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; (E) MISSED, DELAYED, OR INACCURATE ALERTS OR NOTIFICATIONS, INCLUDING BUT NOT LIMITED TO FAILURES IN PUSH NOTIFICATION DELIVERY, DELAYS IN THIRD-PARTY DATA SOURCES, OR INCOMPLETE GEOGRAPHIC COVERAGE; (F) ANY ACTION TAKEN OR NOT TAKEN BY YOU IN RELIANCE ON INFORMATION PROVIDED THROUGH THE SERVICE; (G) ANY PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF LIFE ALLEGED TO RESULT FROM RELIANCE ON THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. Nothing in these Terms limits any statutory rights that cannot be excluded under applicable consumer protection laws. Nothing in these Terms excludes liability for gross negligence, willful misconduct, or death caused by our negligence where such exclusion is not permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless KCraft Studio LTD, its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; (d) any content you submit through the Service. This indemnification obligation does not apply to consumers to the extent prohibited by applicable law.
12. Modifications to Service and Terms
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time. Where reasonably possible, we will provide notice of material changes. We also reserve the right to update these Terms at any time. Material changes will be communicated through the App or by email. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
13. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time through the account settings in the App or by contacting us at legal@cywarn.app. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Cyprus. Notwithstanding the foregoing, if you are a consumer residing in the European Union, you may also bring proceedings in the courts of your country of residence, and you retain any mandatory consumer protection rights granted by the laws of your country of residence.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and KCraft Studio LTD regarding the use of the Service and supersede all prior agreements, understandings, and representations.
